Welcome to Humanising Design (the "Company"). By accessing or using our website and services, you agree to be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not use our website or services.

Acceptance of Terms

By using our website, purchasing our products, or engaging our services, you agree to comply with and be bound by these Terms. The Company reserves the right to update these Terms at any time without notice. It is your responsibility to review these Terms periodically.

Services Provided

Humanising Design offers a range of services to businesses, including but not limited to:

  • Creative branding solutions

  • Product design

  • Digital marketing strategies

  • Strategy consulting

  • Other related services
     

Ownership of Designs

Upon completion of a project and payment in full, Humanising Design grants the client a limited, non-exclusive, and non-transferable right to use the designs provided. However, the Company retains full ownership and intellectual property rights over all designs, concepts, and deliverables sold to the client. Clients are prohibited from reselling, redistributing, or claiming ownership of any designs provided by Humanising Design without prior written consent.
 

Intellectual Property

All content, designs, trademarks, logos, graphics, and intellectual property created by Humanising Design are the exclusive property of the Company. Clients may not use any of our intellectual property without explicit permission, other than for the intended purpose as agreed in the project scope.
 

Client Responsibilities

The client agrees to provide clear and timely communication throughout the project process. Clients must also provide accurate information and materials required for the successful completion of the project. Failure to do so may result in delays or additional fees.
 

Content Validation and Approval

All content, including but not limited to marketing materials, branding assets, and design outputs, provided by Humanising Design must be reviewed and approved by the client before publication or use. The client is solely responsible for validating the accuracy, legality, and appropriateness of the content. Humanising Design will not be held liable for any consequences resulting from the use of unapproved or unchecked content by the client.
 

Project Revisions

Humanising Design offers a specified number of revisions during the design process, as outlined in the project agreement. Additional revisions beyond this scope may incur extra charges. It is the client's responsibility to review and approve all designs before final delivery.
 

Payment Terms

Payment for services rendered must be made according to the payment schedule agreed upon at the start of the project. Humanising Design will assume that the project is halted if payment is withheld or not received as per the agreed payment schedule. Any delays resulting from this will not affect the Company’s right to the original payment schedule, and work will resume only once payment is received in full.
 

Payment Delays and Impact on Deliverables

In the event that payment is delayed, the timelines for deliverables will be automatically adjusted, and the original agreed-upon timeline will no longer be valid. Humanising Design reserves the right to reschedule the delivery of services based on the date of receipt of payment. Any delays caused by late payments will not be the responsibility of the Company.
 

Prohibition on Use of Unpaid Work

In the event that payment for any services or deliverables has not been completed as per the payment schedule, the client is prohibited from using, publishing, or distributing any work provided by Humanising Design. Any use of such work without full payment will result in the client being held liable for breach of contract, and legal action may be taken to enforce payment and protect the Company’s intellectual property rights.
 

Limitation of Liability

  1. Content Liability: Humanising Design is not responsible for any content errors or omissions once the content is approved by the client. The client assumes full responsibility for any consequences, including legal liability, that may arise from the publication or use of the content.

  2. Service Liability: The Company strives to provide the highest level of service; however, Humanising Design is not responsible for any indirect, incidental, or consequential damages that may result from the use of our services. This includes, but is not limited to, loss of revenue, business interruptions, or loss of data.

  3. Third-Party Services: Humanising Design may recommend or collaborate with third-party vendors or platforms as part of its services. The Company is not responsible for the performance, reliability, or actions of these third parties. Any issues that arise with third-party services must be addressed directly with those vendors.

  4. No Guarantees: Humanising Design does not guarantee specific results, outcomes, or increases in revenue, client base, or visibility from the use of its services. The success of a marketing or design project depends on various factors beyond the Company’s control, including market conditions, competition, and client execution of the strategy.

  5. Website Availability: While we endeavor to ensure the website is always available, Humanising Design does not guarantee that the website will be uninterrupted or error-free. We are not liable for any downtime or technical issues that may impact the user experience.
     

Termination

Humanising Design reserves the right to terminate or suspend access to our services at any time, with or without cause or notice. Upon termination, the client must cease all use of any content or designs provided by the Company.
